Ghana Revenue Authority Takes Decisive Action Against Illicit Tobacco Trade

In a significant move to uphold regulatory standards and combat illicit activities, the Ghana Revenue Authority (GRA) has seized illicit tobacco products valued at GH¢7.95 million. The products, which made their way into the country through unauthorized border routes, failed to meet the standard requirements mandated by Ghanaian laws. The GRA, in a statement released on November 21, 2023, revealed the extensive measures taken to address this issue and maintain the nation’s regulatory integrity.

Key Points:

  1. Illicit Tobacco Seizure:
The GRA’s proactive stance led to the confiscation of illicit tobacco products valued at GH¢7.95 million. These products, including brands like Oris Double Apple, Business Royals, Gold Seal, Bon, Yes, and Business Kings, were illicitly brought into Ghana, contravening the Public Health Act, 2012, Act 851, and the Tobacco Control Regulations (TCR), 2016 (L.I. 2247).
  2. Non-Compliance with Standards:
The seized tobacco products did not comply with essential requirements outlined by Ghanaian laws. They lacked graphic health warnings, the “For Sale in Ghana” inscription, and Ghana Tax Stamps, highlighting a blatant disregard for regulatory standards.
  3. Legal Consequences and Investigations:
The GRA emphasized its commitment to initiating investigations to identify and apprehend individuals responsible for this illicit trade. The Authority pledged to collaborate closely with relevant government agencies to ensure the arrest, prosecution, and imposition of appropriate sanctions on those involved.
  4. Destruction of Seized Products:
As part of the legal process, the GRA will adhere to established protocols by destroying all seized products. This step reinforces the commitment to eliminate illicit goods from circulation and prevent their re-entry into the market.
  5. Public Cooperation Encouraged:
The GRA urged the public to actively participate in the fight against illicit trade by reporting any information related to warehouses or storage locations used for hoarding unauthorized tobacco products. This collaborative effort aims to curb the prevalence of illicit activities within the country.

Conclusion:

The GRA’s decisive action against illicit tobacco trade sends a clear message about the commitment to upholding regulatory standards and protecting public health. By seizing and subsequently destroying non-compliant products, the GRA sets a precedent for stringent enforcement of laws governing the tobacco industry. The collaboration with other government agencies and encouragement for public cooperation underscores a comprehensive approach to eradicating illicit trade practices in Ghana.
