OccupyGhana Urges President to Enlist Auditor-General for SML/GRA Contract Audit

Pressure group OccupyGhana has called on President Nana Addo Dankwa Akufo-Addo to reconsider the appointment of KPMG for the audit of the contract between Strategic Mobilisation Ghana Limited (SML) and the Ghana Revenue Authority (GRA). In a statement dated January 5, 2024, OccupyGhana asserted that the move to appoint a private audit firm for the task was potentially unconstitutional, bypassing established provisions. The pressure group emphasized the constitutional importance of Article 187(8), urging the Council of State to advise the President for an “Article 187(8) Public Interest Audit,” wherein the Auditor-General is directly involved.

According to OccupyGhana, any audit conducted by KPMG might face legal challenges due to its potential unconstitutionality. The statement underscored that adhering to constitutional provisions, particularly Article 187(8), would empower the Auditor-General to disallow payments contrary to law and take appropriate action against those responsible. OccupyGhana urged the President to revoke the appointment of the private audit firm and comply with Article 187, emphasizing that Ghana stands to gain by allowing the Auditor-General to conduct the audit. In case the Council of State or the President fails to comply with Article 187, OccupyGhana encouraged the Auditor-General to initiate and conduct the special audit independently, as authorized by section 16 of the Audit Service Act.
